Fair Use Policy

Background

Network Technologies Queensland’s Fair Use Policy is designed to provide a clear understanding of the rules, regulations and restrictions regarding the use of Network Technologies Queensland’s Services.

By registering for and using the Services, and thereby accepting the Terms and Conditions of the Terms of Service Agreement or its equivalent, you agree to abide by the Fair Use Policy as modified from time to time. Any violation of the Fair Use Policy may result in the suspension or termination of your account or such other action as Network Technologies Queensland deems appropriate. An unlisted activity may also be a violation of the Fair Use Policy if it is illegal, irresponsible, or disruptive use of the Internet. No credits will be issued for any interruption in Service resulting from policy violations.

Definitions

“Customer” refers to the entity that has applied for and subsequently agreed to purchasing of Services offered by Network Technologies Queensland;

“Services” or “Service” means any product offered by Network Technologies Queensland Pty Ltd such as NBN, NBN NEBS, Fibre internet connections;

“Agreement” means this agreement for the provision of the Services by Network Technologies Queensland Pty Ltd to you;

“Usage” means the measurement of time or data generated by Your Internet Access;

“Installment Period” means a period no more than two weeks immediately following the Date of Commencement;

“Third-Party” means any legal person who provides us with goods or services related to the provision of NBN Services;

“Service Location” or “Service Location Address” means the location at which a Service is installed;

“Contract Term” means the period that the Customer agrees to pay the monthly fee for each Service.

Application
This Fair Use Policy applies to all Services provided by Network Technologies Queensland, that are in line with the definition of Service/Services provided in the above section.
Harassment
The customer is expected to be familiar with and to practice good Internet Etiquette (Netiquette). The customer will comply with the rules appropriate to any network to which Network Technologies Queensland may provide access.
The customer is not permitted to post any material that is:
Network Technologies Queensland reserves the right to refuse or terminate Service at any time for violations of this section.
Illegal Activity

The customer must not use any Service provided by Network Technologies Queensland for any activity which is illegal or unlawful.

This includes, but is not limited to:
Suppliers and Third-Parties
The customer must not use any service provided by Network Technologies Queensland to undertake any activities which will negatively affect Network Technologies Queensland’s reputation, network services, or other customers. Such activities include, but are not limited to:
Breach of Policy
If Network Technologies Queensland believe the customer has breached this policy in any way, Network Technologies Queensland can and may take action, such as:

If Network Technologies Queensland believes the customer has broken the law, Network Technologies Queensland reserve the right to report the customer to the police and provide them with the customer’s personal contact information and Service usage activities.
